Service Agreement
HOSTING SERVICES USAGE AGREEMENT
(VALID FOR ONLINE APPLICATIONS)
This agreement is intended to regulate the terms of sale and use of Lumiweb LTD & Domain Merkezi hosting services to the Client. The Customer and Lumiweb LTD & Domain Merkezi are in full agreement on all the terms set out below and on the Terms of Use, Privacy Policy and Warranty – Transfer Terms pages and mutually agree to all the clauses on the specified pages.

Hereinafter referred to as ‘Lumiweb LTD & Domain Merkezi’.

customer: The person or entity who approves this agreement at the time of application to the online hosting sales department of Lumiweb LTD & Domain Merkezi.
ENTRY INTO FORCE AND DURATION OF THE CONTRACT
The contract comes into force with the online application to be made by the Customer from the website of Lumiweb LTD & Domain Merkezi and the contract is indefinite.
NOTICES
Lumiweb LTD & Domain Merkezi will use the e-mail address provided by the customer during the registration process for all notifications to the customer. It is the customer’s responsibility to ensure that this address is a valid address. In case of disputes, the customer may be asked to provide a payment receipt or payment record to prove that they are the account authority. If the payment is made by a company, the company’s authorisation certificate may be requested together with the receipt, and if the payment is made individually, the identity card information of the payer may be requested. When this information and documents are provided, the account can be transferred to the new user. Since the person / institution making the payment is the account authority, in case of dispute, the party that can provide the specified information and documents will be considered the sole authority of the account.
The customer declares that the information to be notified to Lumiweb LTD & Domain Merkezi during online registration and/or later is correct and up-to-date. Lumiweb LTD & Domain Merkezi accepts in advance that the customer will not claim any compensation for damages through Lumiweb LTD & Domain Merkezi due to any disruptions and damages that may occur due to incorrect, incomplete or outdated information reported by the customer.
In the free hosting packages included in the campaign, Domainmerkezi.net may terminate the service provided when it deems necessary by giving 1 week notice. Technical support is not provided in free packages.
ANNOUNCEMENTS AND INFORMATION
Domainmerkezi.net can make promotions, announcements and opportunity notifications about its services via email and sms. The user who accepts the contract is deemed to have accepted this. Users who do not want to receive e-mail in any way will be able to contact Domainmerkezi.net after membership and ensure that their e-mail and phone number are completely disabled. Domainmerkezi.net does not share the contact information of the user with other persons and companies in any way.
FEES AND PAYMENT
The Client agrees to pay the usage fees and related taxes (depending on the service content used) related to Lumiweb LTD & Domain Merkezi hosting services. Fees will be collected in advance at the beginning of each usage period. At this stage, the user gives an automatic payment order during the payment process and allows the payments to be made for the following periods to be automatically withdrawn via the credit card he / she prefers, and the transaction can be cancelled at the request of the user regardless of the commitment procedure.
Campaigns cannot be combined and a maximum of 1 campaign can be utilised in each order. If more than one campaign is active, the user is free to choose the campaign of his/her choice.
Lumiweb LTD & Domain Merhezi notifies the service fees to the customer at the time of the contract via written document, web page or e-mail. Lumiweb LTD & Domain Merkezi reserves the right to regulate all kinds of service charges. Future changes in service fees will be notified to the customer via Lumiweb LTD & Domain Merkezi website and / or e-mail. The Customer’s continued use of Lumiweb LTD & Domain Merkezi services constitutes acceptance of the terms of the current contract and payment of the applicable fee schedule.
In Cloud and DEDICATED Servers, account closure and transition to upper or lower packages must be notified by the user 7 business days before the account cut-off date. Otherwise, the transition process will be transferred to the next month and the user will pay for the package currently used in the current month.
Lumiweb LTD & Domain Merkezi reserves the right to change the package price and features in the fee changes to be made by the license providers for the control panel or other licenses, and to invoice the difference amount that may occur.
Lumiweb LTD & Domain Merkezi reserves the right to replace the hosting control panels offered to the customer and/or the licences offered within the services with other equivalents when deemed necessary.
Software / design services offered by Lumiweb LTD & Domain Merkezi are non-refundable as in the whole world. Within the scope of the mutual agreement with the user, part of the payment is made in advance and part of the payment is made upon delivery. The user examines the project at the time of project delivery and has the right to make changes and arrangements within the scope of the previously notified project obligations for 1 week. Following the completion of these arrangements, the project delivery is completed by receiving the payment of the remaining amount within the scope of the previously mutually agreed fee.
BY ACCEPTING THIS AGREEMENT, THE CUSTOMER AUTHORISES THE RELEVANT FEES TO BE CHARGED TO THE CREDIT CARD ACCOUNT PROVIDED BY THE CUSTOMER AT THE TIME OF REGISTRATION.
LIMITED LIABILITY OF Lumiweb LTD & Domain Merkezi
Lumiweb LTD & Domain Merkezi will make reasonable efforts to ensure the continuity of the services provided to the customer. Lumiweb LTD & Domain Merkezi DOES NOT WARRANT THAT THE SERVICES WILL FULLY MEET THE CLIENT’S NEEDS, THEIR INTEGRITY, ERROR-FREE AND RELIABILITY LEVEL. Lumiweb LTD & Domain Merkezi LIABILITY FOR DIRECT AND/OR INDIRECT LOSSES OF CUSTOMER ARISING OUT OF THE USE AND/OR INABILITY TO USE ANY SERVICES PROVIDED UNDER THIS AGREEMENT MAY BE AT MOST THE TOTAL COST OF THE SERVICES PROVIDED. Domainmerkezi.net DOES NOT PROVIDE BACKUP SERVICE AND WARRANTY IN LINUX HOSTING SERVICES. USERS RECEIVE THE BACKUP OF THEIR SITES WITH A SINGLE BUTTON IN THEIR CONTROL PANEL AT THE FREQUENCY THEY WISH.
validity of Lumiweb LTD & Domain Merkezi registrations
Except where otherwise stated, the records of Lumiweb LTD & Domain Merkezi shall be deemed to be valid in relation to the online transactions to be made by the customer.
TRANSFER OF CUSTOMER’S RIGHTS
The customer can transfer its services under this contract from the customer panel without the approval of Lumiweb LTD & Domain Merkezi. Lumiweb LTD & Domain Merkezi is in no way responsible for any disputes that may arise from the transfer process.
Users are responsible for illegal activities carried out in the opened domain name and hosting.
TERMINATION OF THE CONTRACT
In the event that the customer violates the terms and conditions set forth in this agreement or in the Lumiweb LTD & Domain Merkezi Terms of Service, Lumiweb LTD & Domain Merkezi may terminate the services provided to the customer without prior notice and terminate the agreement. In this case, the fees paid by the customer in advance will not be refunded. The customer can terminate the contract at any time, with 5 working days notice, by written application (mail, e-mail) to Lumiweb LTD & Domain Merkezi. Only applications made within the first 15 days after the start date of the account for which the annual payment is made are eligible for a refund. Information about this is published on the Guarantee Terms page. There is no refund for accounts more than 15 days after the account start date. Insulting and derogatory speech of users who receive service and technical support from Domainmerkezi.net is a reason for termination of contracts. Domainmerkezi.net reserves the right to interrupt service in undesirable situations such as swearing and insults.
ACCEPTANCE OF SERVICE USE CONDITIONS
By confirming this agreement and depositing funds into the Lumiweb LTD & Domain Merkezi bank accounts, the Customer accepts the current ‘Lumiweb LTD & Domain Merkezi Terms of Service’. The current version of the ‘Lumiweb LTD & Domain Merkezi Terms of Service’ is published on the Terms of Service page of Lumiweb LTD & Domain Merkezi.
VALIDITY OF THE ONLINE CONTRACT
Changes to this agreement, which the customer approves during the online application, will be published on the website of Lumiweb LTD & Domain Merkezi https://www.domainmerkezi.net/hizmet-ve-kullanim-sozlesmesi and will enter into force. Domainmerkezi.net reserves the right to update or edit the agreement unilaterally and without prior notice at any time. It is the user’s responsibility to regularly review the agreement for any possible changes. By continuing to use Lumiweb LTD & Domain Merkezi services, the customer will be deemed to have accepted the terms of the contract in force https://domainmerkezi.net/hizmet-ve-kullanim-sozlesmesi/.
OUR RETURN CONDITIONS
The services you purchase from our company (except Server, Licence and domain name registration service) have a 100% refund (return) guarantee within 14 days without question. These refunds are added to the customer account as available money balance. After 14 days (excluding server, licence and domain name registration service), if our customer wants to return it, transactions can be provided at the initiative of Lumiweb LTD & Domain Merkezi as the legal return period will have expired. It is not possible to return the free services (such as free domain name registration) offered with the service in the campaign services. Free services are given to the customer because the customer has committed to the service and will use the service for the period of purchase. If the service is cancelled before this period, the free service continues to be available to the user during the period of use. Since domain name registration procedures are automatically performed by ICANN and TRABIS (ICTA), refunds are not possible. In refund transactions, our customer is refunded in the same way as the payment method with which our customer paid. It is not possible to refund to a different person or by a different method. For all refund transactions, you can make a request to us by selecting the accounting department through your customer panel.
